  1. Introduction

Welcome to the website operated under the JAJI brand, including JAJI Parfums and JAJI Labs (the “Site”).

This Site is operated by JAJI Fragrances and Homewares (ABN 32 886 869 536) (“JAJI”, “we”, “us”, “our”). In certain cases, services and bespoke fragrance work may also be delivered under JAJI Parfumerie (ABN 23 704 934 472), as disclosed within these Terms.

By accessing or using this Site, you agree to be bound by these Terms & Conditions, our Privacy Policy, and any additional policies referenced herein.

These Terms govern your use of the Site and any purchases or services offered through it.

 

  1. The JAJI Brand Structure

JAJI operates through two interconnected divisions:

JAJI Parfums

Retail fragrance, home fragrance, and related products available for purchase through the Site.

JAJI Labs

Bespoke fragrance creation, commissioned scent development, olfactive branding, and private fragrance services.

Where applicable, contractual arrangements will be entered into with the relevant operating entity depending on the nature of the product or service.

 

  1. Eligibility

To purchase from this Site, you must:

  • Be at least 18 years of age or have legal capacity to enter into a contract under Australian law; and
  • Provide valid and complete billing and delivery information; and
  • Use an accepted payment method.

Guest checkout is permitted. Creating an account is optional.

 

  1. Use of the Site

You agree to use this Site only for lawful purposes and in accordance with these Terms.

You must not:

  • Interfere with or disrupt the Site’s operation
  • Attempt unauthorised access to systems or data
  • Use automated tools to extract data without permission
  • Misrepresent your identity or payment details

We reserve the right to refuse service, cancel orders, or restrict access where misuse is suspected.

 

  1. Products and Services

5.1 JAJI Parfums

We make reasonable efforts to ensure product descriptions, imagery, and pricing are accurate. However, minor variations in packaging, colour, presentation, or formulation may occur due to production updates or material differences.

5.2 Availability

All products are subject to availability. We may withdraw or modify products at any time without notice.

 

  1. Orders and Contract Formation

When you place an order:

  1. You will receive an order confirmation email acknowledging receipt of your order.
  2. This confirmation does not constitute acceptance of your order.
  3. A contract is formed only when your order is dispatched.

We reserve the right to cancel or refuse any order, including where:

  • A product is unavailable
  • Payment cannot be authorised
  • Pricing or product errors occur
  • Fraud or misuse is suspected

If your order is cancelled after payment, you will be refunded in full.

 

  1. Pricing and Payment

All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.

Prices may change at any time without notice; however, the price charged will be the price displayed at the time of order.

We accept approved payment methods displayed at checkout, including credit/debit cards and PayPal.

You confirm that all payment details provided are valid and authorised for use.

 

  1. Shipping and Delivery

We deliver within Australia and possibly to selected international destinations.

Delivery timeframes are estimates only and may vary due to external factors including courier delays, customs processing, or peak periods.

Risk in the goods passes to you upon delivery.

 

  1. Returns, Exchanges & Australian Consumer Law

We comply with the Australian Consumer Law (ACL).

You are entitled to a replacement, repair, or refund where goods are:

  • Faulty
  • Damaged on arrival
  • Not as described
  • Do not meet consumer guarantees under the ACL

Change of mind

Due to the nature of fragrance and personal care products, we do not offer returns for change of mind where products have been opened or used.

Unopened and unused items may be considered for return at our discretion.

This does not limit your rights under Australian Consumer Law.

 

  1. JAJI Labs – Bespoke Fragrance & Commissioned Work

JAJI Labs provides bespoke fragrance development, commissioned scent creation, and related creative services.

10.1 Nature of Work

All bespoke fragrance projects are custom-developed intellectual works created for a specific client brief.

10.2 Intellectual Property

Unless otherwise agreed in writing:

  • JAJI retains full ownership of all fragrance formulas, compositions, processes, techniques, and development materials
  • The client receives approval or a licence to use the final fragrance for the agreed purpose only
  • The underlying formula is not transferred, disclosed, or assigned to the client

10.3 Exclusivity

Where exclusivity is agreed:

  • Exclusivity applies only as expressly stated in the project agreement
  • JAJI will not reproduce the agreed fragrance for another commercial client during the exclusivity period

10.4 Confidentiality

All bespoke development discussions, formulations, and processes are treated as confidential unless otherwise agreed.

 

  1. Intellectual Property

All content on this Site, including but not limited to:

  • Text
  • Branding
  • Logos
  • Images
  • Product designs
  • Fragrance descriptions
  • Visual assets

are owned or licensed by JAJI and protected under applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without prior written consent.

 

  1. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Indirect or consequential loss
  • Loss of profits or revenue
  • Delays or interruption of service
  • Third-party website content or services

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded.

Where liability cannot be excluded, it is limited to the replacement or resupply of goods or services, or payment of the cost of same, as determined by us.

 

  1. Indemnity

You agree to indemnify JAJI against any claims, losses, liabilities, damages, or expenses arising from your misuse of the Site or breach of these Terms.

The Site may contain links to third-party websites. These are provided for convenience only.

We are not responsible for the content, accuracy, or policies of third-party websites.

 

  1. Privacy

Your use of this Site is also governed by our Privacy Policy, which explains how we collect, use, and store your personal information.

We may update these Terms at any time. Updated versions will be posted on this page and take effect immediately upon publication.

Continued use of the Site constitutes acceptance of any changes.

 

  1. Governing Law

These Terms are governed by the laws of Queensland, Australia, and you submit to the exclusive jurisdiction of the courts of Australia.
